technique

The Accident Reconstruction Technician intervenes in serious accident cases in which there is the need to reconstruct the dynamics and kinematics of the accident in order to ascertain the terms of occurrence, the behaviours and the liabilities of the parties involved.

The most common cases are those that result in serious and/or fatal injuries for the persons involved, material damage to third parties, in general, disputes not solved by mutual agreement of the parties.

According to the sphere in which he performs his activity, the Accident Reconstruction Technician can take different roles and denominations.

  • Judicial phase :

Technical Consultant for the Prosecution: is appointed by the Public Prosecutor in the course of preliminary investigations if there is the need to take penal action against one of the parties (in case of death and/or injuries of the persons involved).

Expert Witness for the Judge: is appointed by the Judge in a penal trial.

Technical consultant for the parties: is appointed by the parties who, in trials (both civil and penal) can avail themselves of the aid of an Expert Technician. He takes part, together with the expert witness appointed by the judge, in carrying out the technical surveys needed to reconstruct the event.

  • Extra-judicial phase:
  • The Accident Reconstruction Technician can be requested by an insurance company needing to reconstruct the dynamics of an accident in the case of objection to a claim of damages.

No matter who the ordering party is, the work of the reconstruction technician always starts from the results of the event (location, extent and typology of vehicle damage, traces on the ground, typology and location of personal injuries) in order to scientifically reconstruct the phases of occurrence as needed to determine the initial conditions. The input data of the process generally consist in the information delivered in the report prepared by the investigating authority (ascertainers who intervened), along with the measurements effected.
These consist in a scaled topographic map of the place of the accident, with indication of the idle positions of the vehicles, of traces on the ground and other data of interest, photographic documentation of the vehicles and places immediately after the accident, statements from the protagonists and witnesses.

The Accident Reconstruction Technician intervenes when an analysis of the dynamics and kinematics of the accident is needed in order to establish the responsibilities in the conducts of the parties involved.
